Terms of Service

Section 1. General Provisions

Article 1. Definitions

  1. Agreement — Agreement on Use of Stores.
  2. Basic Service — Mail-order services provided by the store owner ("We," "Our" or "Us") through the Internet.
  3. Purchasers — A person who makes an offer to purchase goods according to the procedures prescribed by Us, after understanding and accepting all of the terms of this Agreement and the Privacy Policy.
  4. User — Collectively refers to a person who retrieves, views or uses Content (images, text, designs, logos, videos, programs, ideas or other information) provided by Us through the Basic Service, after accepting this Agreement and the Privacy Policy.

Article 2. Application of Agreement

We have established this Agreement to enable Users to make use of the Basic Service We provide on the Internet. By starting to use the Basic Service, the User is deemed to have accepted the terms of this Agreement.

Article 3. Changes to This Agreement

If deemed necessary, We may amend this Agreement within the scope of the purposes of the Basic Service. We will notify Users and Purchasers in advance of amended terms and the effective date by posting on Our website or by other appropriate means. Users are deemed to have accepted the amended Agreement if they use the Basic Service on or after such effective date.

If a purchaser's name, address or other submitted information changes, the purchaser shall promptly notify Us. Any transaction already processed prior to such registration shall be fulfilled based on the information prior to the change.

Article 9. Prohibitions

  1. Any act that causes or is likely to cause trouble, disadvantage, or damage to any other User, third party or Us.
  2. Any act that infringes intellectual-property, personal, portrait, privacy or publicity rights of Us or third parties.
  3. Any act against public order, decency or laws and ordinances.
  4. Using Content beyond the limits of personal use.
  5. Reproducing, selling, publishing, distributing or disclosing Content, or similar acts.
  6. Any act hindering the operations of the Basic Service or other services.
  7. Any act reasonably considered to damage Our reputation.
  8. Any other act deemed inappropriate by Us.

Section 5. Disclaimers

Article 10. Disclaimers

  1. We accept no liability for damage incurred by third parties as a result of a User's or Purchaser's breach of this Agreement.
  2. We make no warranty as to completeness, accuracy, reliability or usefulness of the Basic Service or information obtained through it.
  3. We do not generally accept liability for damage arising from use of the Basic Service. However, where the contract constitutes a Consumer Contract under the Consumer Contract Act, clauses fully releasing Us from liability shall not apply; in such case liability is limited to the amount paid by the User in the one year preceding the damage, unless caused by Our intent or gross negligence.
  4. If a Purchaser fails to receive goods (refusal, long absence, unknown address, etc.), We fulfill Our delivery obligation by contacting the registered details and bringing/shipping to the designated address, whereupon We are released from the obligation.

Section 6. Miscellaneous Provisions

Article 11. Copyrights and Intellectual-property Rights

All Content provided by the Basic Service is vested exclusively in Us or duly authorized third parties. Should infringement problems arise between Users/Purchasers and third parties, said Users/Purchasers assume responsibility and costs for resolution without causing Us damage.

Article 12. Applicable Legislation

This Agreement is subject to all the laws and ordinances of Japan.

Article 13. Negotiations and Court of Jurisdiction

We and the relevant User or Purchaser shall strive to resolve, through good-faith consultation, any matters not specified herein or questions of interpretation. The court having jurisdiction over Our location shall have exclusive jurisdiction as the court of first instance over all disputes related to this Agreement.
